  1. Introduction

Welcome to the House of Velas® website.  These Terms of Use & Service (“Terms”) govern your use of our website, House of Velas (https://houseofvelas.com) and the purchase of our products, including candles and related items (the “Products”). House of Velas of part of VH Home Fragrance Inc (a Delaware Company with offices in Charleston, SC) and the names may be used interchangeably.

By accessing our website and/or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.   Use of our website is provided strictly subject to your acceptance of these Terms of Use and Privacy Policies.

We reserve the right to revise these Terms of Use and Service from time to time as we deem necessary and without notice.  You should check these terms of use and service periodically. By using the Site after we post changes to these Terms of Use and Service, you agree to accept those changes, whether or not you actually reviewed them.

 

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to purchase products from our website.

 

3. Products and Use Warnings

Our products are candles intended for personal, household use only, and by purchasing our candles, you expressly agree to use our products by complying with the safety instructions set forth below.

Candle Safety Instructions & Disclaimer:
Candles involve an open flame and must be used responsibly. Always follow these safety instruction and any other safety instructions included with your candles.

● Never leave a burning candle unattended

● Keep away from children, pets, and flammable materials.

● We are not responsible for damage or injury resulting from misuse. 

● Always place all candles on a heat-resistance surface away from drafts.  

● Keep Wicks Trimmed.   Our candles will not create smoke if used properly; to prevent smoke (aka “sooting”, which is caused by incomplete combustion) always keep the wicks centered and trimmed to approximately ¼” between uses.  Allowing a wick to extend beyond ¼” will affect combustion and may result in smoke (or sooting) which can easily be avoided by keeping the wick at the proper length.  Remove wick trimmings and keep wick trimmings and any other debris clear from the wax pool.

● DISCONTINUE USE when ½” of wax remains. Otherwise, the flame may come too close to the base of the candle and overheating and even breakage may result.

● Do not burn continuously for longer than 4 hours. 

● Never extinguish flame with water; flame can be safely extinguished by gently blowing it out or smothering the flame but putting the lid back on the candle.  

● NEVER light any candle before you go to bed or sleep as all candles should be attended at all times when lit.

 

4. Entire Agreement & Mandatory Arbitration Agreement:

READ THIS ENTIRE AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS OF USE AND SERVICE FOR YOUR USE OF THE WEBSITE AND PURCHASE OF ANY PRODUCTS FROM OUR COMPANY.

THIS AGREEMENT CONTAINS A MANDATORY DISPUTE RESOLUTION PROVISION AND ARBITRATION AGREEMENT WITH A CLASS ACTION WAIVER THAT AFFECTS YOUR LEGAL RIGHTS. THIS ARBITRATION AGREEMENT REQUIRES THAT DISPUTES BE RESOLVED IN INDIVIDUAL ARBITRATION OR SMALL CLAIMS COURT.

 

5. Orders and Payment

  • All prices are listed in US Dollars and are subject to change without notice.
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud or inventory limitations.
  • Payment must be completed at checkout using approved payment methods.

 

6. Shipping and Delivery

  • Shipping times are estimates and not guaranteed.
  • Risk of loss passes to you upon delivery to the carrier.
  • We are not responsible for delays caused by carriers, customs, or events beyond our control.

7. Returns and Refunds

At House of Velas, we want you to love your purchase. If for any reason you’re not satisfied, returns may be requested following the guidelines below.

Our return and refund policy is available at House of Velas Return Policy and is incorporated into these Terms.

Unless otherwise stated:

  • Used or burned candles are not eligible for return.
  • Refunds are issued only after inspection of returned items.
  • Shipping costs are non-refundable unless required by law.

 

8. Intellectual Property

All content on this website, including text, images, logos, product descriptions, and designs, is the property of House of Velas and VH Home Fragrance Inc (and/or related companies) or their assigns or licensors and may not be used without prior written permission

 

9. Prohibited Uses

You agree not to:

  • Use the website for unlawful or fraudulent purposes
  • Attempt to interfere with website security or functionality
  • Misrepresent your identity or payment information
  • Use the Site in any manner that violates any applicable federal, state, local, or international law or regulation.

11. Governing Law and Mandatory Arbitration

These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict-of-law principles. 

    1. By accessing the Site, you agree to be subject to the Terms and Conditions, and all applicable laws, as governed by the laws of the State of South Carolina. You also consent to the personal jurisdiction of a court of competent jurisdiction in the State of South Carolina.

 

    1. Except for claims we may bring against you for violations of Section 9 (Prohibited Uses) or Section 8 (Intellectual Property), all disputes will be resolved per Sections 11(C) below and the following.

 

    1. In the interest of resolving disputes between you and House of Velas in the most expedient and cost-effective manner, you agree that any dispute arising out of or in any way related to our Terms and Conditions will be resolved by binding arbitration before the American Arbitration Association in the State of South Carolina. Arbitration uses a neutral arbitrator instead of a judge or jury, which may allow for more limited discovery than in court and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award.

 

D) YOU MAY BRING CLAIMS AGAINST US ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and House of Velas agree otherwise in a signed writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

 

  1. Any arbitration between you and House of Velas will be governed by the Federal Arbitration Act and the Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by our terms herein, and will be administered by the AAA. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778- 7879. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.

 

  1. Notice & Process: If you or House of Velas intends to seek arbitration, then the party seeking arbitration must first send a written notice of the dispute to the other party by U.S. Mail ("Notice"). House of Velas address for Notice is: 215 East Bay Street, STE 304, Charleston, SC 29401, USA, Attn: Chief Executive Officer and General Counsel. The Notice must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). You and House of Velas will make good faith efforts to resolve the claim directly, but if we cannot reach an agreement to do so within 30 days after the Notice is received, you or House of Velas may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or House of Velas must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any.
